Conventionality Control in the Inter-American System of Human Rights IMPLICATIONS IN THE ARGENTINE CONSTITUTIONAL CODE OF LAWS.

Abstract. The doctrine of conventionality control has vague contours. The two central themes through which the main lines of conventionality control circulate are the internationality of constitutional law, and the constitutionality of international law. The aim of this paper is to discuss whether in the exercise of the conventionality control the interpretation of the American Convention on Human Rights by the Inter-American Court of Human Rights is binding on our local courts, particulary on the Argentine Supreme Court of Justice. The solution to this question is through the consistent interpretation of the law, applying the large doctrine guidelines where consensus have been set without any
serious difficulties and debates, and acknowledging that complex issues deserve above all an implementation of the normal prudence rules, at least until revealing an enduring doctrine based on the principle of legal certainty.
