Thoughts on the principle of equality in the case law of the Supreme Court of Justice of Uruguay.

Abstract. It is from a reasoning which has been historically held by the Supreme Court of Justice as regards the cases of unconstitutionality on account of the infringement of the principle of equality that references are proved to correspond to a period in excess of comparative law and whose current use compromises the analysis of the matter within the national case law. Upon the identification of the problem, there arises the need to urgently update case law in such a crucial area.
