ABSTRACT: This paper examines the question of the judicial evidential activity in criminal proceedings, from coping issues that are inherent, namely the criminal proceedings itself, the truth sought in criminal procedure and the procedural systems, notably because of the actuality of these subject in Brazil. Finally, it aims to demonstrate that such evidential activity is linked with the adversarial system that is desired.
